29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   (a)  On or about 05/21/13, at Michelina's Restaurant, located on 2700 West Henrietta Road, in Rochester, New York, fall protection was not provided to workers, painting the roof edge, 15 feet above ground level.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:   (a)  On or about 05/21/13, at Michelina's Restaurant, located on 2700 West Henrietta Road, in Rochester, New York, a stairway and or ladder was not provided between roof levels measuring 5 feet 4 inches, where workers accessed the top roof level.  NO ABATEMENT CERTIIFICATION REQUIRED
