The excavation, trucks, and equipment were located in the southbound lane of Nebraska Avenue.

29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA: a/ At the job site, on or about 05/22/13, flaggers or the equivalent were not posted at either end of Nebraska Avenue where the work zone existed. The work zone existed in the southbound lane of Nebraska Avenue. Employees were installing a water pipe in an excavation. Heavy traffic was observed driving in both directions while the work was progressing.

29 CFR 1926.202: Barricades for protection of employees did not conform to the portions of the American National Standards Institute D6.1-1971, Manual on Uniform Traffic Control Devices for Streets and Highways, relating to barricades: a/ At the job site, on or about 05/22/13, specifically at the southbound and northbound lanes of Nebraska Avenue, two, portable barricades were placed at either side of the backhoe where employees were installing pipe in an excavation. The excavation, trucks, and equipment were located in the southbound lane of Nebraska Avenue. No orange traffic cones or the equivalent were posted. The taper ratio for barricades for a residential, urban street width would require a minimum of eight traffic cones or the equivalent at each end of the work zone. The lack of cones provided motorists with little warning to steer clear of the four-hour old work zone.
