29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a. Parish Center Being Constructed: The employee operating the CAT 350 B rough terrain fork lift could not read the load rating chart and left the forks up approximately 4 feet 3 inches up off the ground while parked and the employee was not trained to operated this powered industrial truck as determined on 5-22-13.  ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM

Site Area of Parish Center Under Construction:  The operator was not wearing the seat belt of the CAT 416 rubber tired back hoe as he was moving it around the site as determined on 5-22-13.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a. First Floor: West Wall  Employees were exposed to a fall of approximately 11 feet 6 inches to the ground due to there was only 1 top rail installed at approximately 40 inches off the concrete floor per each of the three 14 feet wide openings as observed on 5-22-13.

East Wall Columns: There was an opening in the shape of a triangle around each of the 7 structural steel columns at the base which measured approximately 22 inches by 22 inches and were approximately 6 inches deep that were not covered to prevent employees from tripping or stepping into the holes as observed on 5-22-13.
