29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification.  a) Gold Tex Apartments, Staircase #1, 2nd floor - The employer did not install and use type NM-8 wire in accordance with listing, labeling, or certification, thus exposing employees to shock hazards.  Observed on or about May 30th, 2013.  b) Gold Tex Apartments, Staircase #1, 3rd floor - The employer did not install and use type NM-8 wire in accordance with listing, labeling, or certification, thus exposing employees to shock hazards.  Observed on or about May 30th, 2013.  NFPA 70 - Article 334.12(9) - Types NM cables shall not be embedded in poured cement, concrete, or aggregate.

Observed on or about May 30th, 2013.    b) Gold Tex Apartments, Staircase #1, 3rd floor - The means of egress through staircase #1 in the center of the building did not remain free from all obstructions or impediments for full and instant use in case of an emergency. 29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high.  a) Loading dock on Vine Street side of building - Employees loading material onto a first floor loading dock were exposed to a fall hazard of approximately seven and a half (7.5) feet without the use of a complete guardrail system.  Observed on or about May 30, 2013.
