29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:  On or about 5/29/13, employees of K&D Transportation were entering Timpte semi-trailer hoppers to clean after unloading when the employer had not evaluated these spaces to determine whether they were permit-required confined spaces.  Employees entering the trailer hoppers were exposed to falling into hazardous machinery or areas below due to slippery converging sides, as well as other potential hazards such as engulfment and falls.

29 CFR 1910.146(c)(2): If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces.   NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.  On or about 5/29/13, employees of K&D Transportation were entering Timpte semi-trailer hoppers to clean after unloading without these spaces being posted or employees being informed of the dangers posed by the spaces.  Employees entering the trailer hoppers were exposed to hazards of falling into hazardous machinery or areas below due to slippery converging sides, as well as other potential hazards such as engulfment and falls.

Employees entering the trailer hoppers were exposed to hazards of falling into hazardous machinery or areas below due to slippery converging side, as well as other potential hazards such as engulfment and falls.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:   On or about 5/29/13, employees of K&D Transportation were entering Timpte semi-trailer hoppers to clean after unloading without these spaces being posted or employees being informed of the dangers posed by the spaces.  Appropriate training was not provided to the employees so that they could perform their duties safely.  Employees entering the trailer hoppers were exposed to hazards of falling into hazardous machinery or areas below due to slippery converging side, as well as other potential hazards such as engulfment and falls.
