29 CFR 1926.28(a):   Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions:  A.)  Sheckler Contracting, Inc., 1807 East 18th Street, Erie, PA  16510, east side of the structure, on or about June 3, 2013 and times prior thereto:  Employees were utilizing powered tools, including, but not limited to, air nailers to affix shingles to the roof.  Employees were not wearing eye protection while working with the nailers and around nailing operations.

29 CFR 1926.404(b)(1)(i):   Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites:   A.) Sheckler Contracting, Inc., 1807 East 18th Street, Erie, PA  16510, south side of the structure, on or about June 3, 2013 and times prior thereto:  An employee was utilizing a Milwaukee Electric Shearing tool (Cat #:  6852-20, Serial #:  A80CD12070272) to cut sheet metal.  The tool was powered via a 10000 watt generator.  The 120 V outlet on the generator was not equipped with GFCI, nor were other GFCIs utilized.  An assured equipment grounding program was not utilized as an alternative means of protection.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b):   A)  Sheckler Contracting, Inc., 1807 East 18th Street, Erie, PA  16510, east side of the structure, on or about June 3, 2013 and times prior thereto:  Employees were conducting roofing activities, including but not limited to re-shingling a roof.  Employees were wearing personal fall arrest systems, but were not tied into an anchorage point.  Employees were exposed to a fall hazard of 9.4 feet to the ground below.
