29 CFR 1910.133(a)(1): The employer shall ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) On or about July 17, 2013, at establishment, during and after performing embalming procedure, the Funeral Director did not wear safety glasses or other face protection while handling formaldehyde solutions when embalming and when sanitizing surfaces after embalming with bleach solution.

29 CFR 1910.1030(d)(3)(ii): The employer did not ensure that the employee used appropriate personal protective equipment unless the employer showed that the employee temporarily and briefly declined to use personal protective equipment when, under rare and extraordinary circumstances, it was the employee's professional judgment that in the specific instance its use would have prevented the delivery of health care or public safety services or would have posed an increased hazard to the safety of the worker or co-worker: (a) On or about July 17, 2013, at establishment, during and after performing embalming procedure, the Funeral Director did not wear safey glasses or other face protection while performing an embalming procedure.

29 CFR 1910.1048(d)(4): The employer discontinued periodic monitoring for employees without results from two consecutive sampling periods taken at least 7 days apart that showed that employee exposure was below the Action Level and the STEL: (a) On or about 6/4/2013, at establishment, formaldehyde exposure monitoring during an embalming procedure was previously conducted in April 1993. One 10-hour Time Weighted Average (TWA) sample was obtained on 4/16/1993 and one 15 minute Short Term Exposure Limit exposure sample was collected on 4/17/1993. No other exposure monitoring has been conducted.
