OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to the hazard of being struck by heavy equipment:  On or about June 4, 2013, employees were using the Bobcat Skid-Steer Loader, Model #S175, with auger attachment to dig fence posts holes along the perimeter of the property. The employer did not ensure that the employees were kept clear of all moving parts of the machine, exposing employees to the hazard of being struck by heavy equipment.
