OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A fall hazard while standing on the top cap of 6 foot fiberglass step ladder.  (a). Elevated walkway - On or about June 5, 2013 an employee was observed standing on the top cap of a 6 foot fiberglass step ladder while repairing an air conditioning unit.
