29 CFR 1910.1030(g)(2)(vii): The employer's training program did not contain the minimum elements required by 29 CFR 1910.1030(g)(2)(vii)(A) through (g)(2)(vii)(N):  a. On or about June 6, 2013, nurses, orderly, radiology technicians, and surgical technicians were exposed to bloodborne pathogen hazards while performing activities such as, but not limited to, starting IVs, assisting surgeons during procedures, cleaning OR suites, and transporting biohazard containers.  The employer's bloodborne pathogens training did not include:    1. An accessible copy of the regulatory text of this standard and an explanation of its contents; 2. A general explanation of the epidemiology and symptoms of bloodborne diseases; 3. An explanation of the appropriate methods for recognizing tasks and other activities that may involve exposure to blood and other potentially infectious material; 4. Information on the types, proper use, location, removal, handling, decontamination and disposal of personal protective equipment; 5. An explanation of the basis for selection of personal protective equipment; 6. Information on the hepatitis B vaccine, that included information on its efficacy and safety method of administration.

29 CFR 1910.1030(h)(1)(i): The employer did not establish records in accordance with 29 CFR 1910.1020 and maintain an accurate medical record for each employee with occupational exposure:  a. On or about June 6, 2013, the employer did not maintain accurate records of the nurses and surgical technicians hepatitis B vaccination series or signed declination letters while transitioning the records from the local office to corporate human resources offices.

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv):  a. On or about June 6, 2013, the employer's hazard communication training did not include:  1. Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area, and    2. The physical and health hazards of the chemicals in the work area such as, but not limited to, compress gases such as oxygen and carbon dioxide and disinfectants used in the facility.

29 CFR 1910.1048(m)(1)(iii): The employers did not include formaldehyde in the hazard communication program established to comply with the HCS (� 1910.1200). Employers did not ensure that each employee had access to labels on containers of formaldehyde and to safety data sheets, and were trained in accordance with the requirements of HCS and paragraph (n) of this section:   a. On or about June 6, 2013, at the pathology laboratory, employees poured into a container a 10% Formalin solution to preserve human tissue and the employer did not provide training on the health hazards associated with the handling of formaldehyde and did not include formaldehyde in their hazard communication program or training program.
