29 CFR 1910.107(b)(5)(iv): Space within the spray booth on the downstream and upstream sides of filters shall be protected with approved automatic sprinklers.    a. On or about June 05, 2013, in the facility, employees were required to work inside a spray booth using flammable paints that contained chemicals including, but not limited to xylene and acetone. The flammable paints were sprayed without the protection of an automatic sprinkler system for the upstream and downstream side of the filters. Employees were exposed to the hazards associated with fires.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:    a. On or about June 05, 2013, at the above located jobsite, employees were provided with and required to wear a tight fitting, filtering face piece respirator (3M - FT10) for use during spray finishing. The employer did not develop or implement a written respirator program that included the provisions with worksite specific procedures for mandatory use.

29 CFR 1910.334(a)(2)(ii): If there is a defect or evidence of damage that might expose an employee to injury, the defective or damaged item shall be removed from service, and no employee may use it until repairs and tests necessary to render the equipment safe have been made.     a. On or about June 05, 2013, at the above located workplace, employees were required to use cord and plug equipment including, but not limited to extension cords and a battery charger, on a daily basis. The ground pins for multiple extension cords were missing. The battery charger was missing a ground pin and had not been removed from service.           b. On or about June 05, 2013, at the above located workplace, employees were required to use cord and plug equipment including, but not limited to the Ridgid vacuum, on a daily basis. The insulation on the electrical cord for the vacuum was visually damaged had not been removed from service.     Employees were thereby exposed to the hazards associated with electrical shock.

On or about June 05, 2013, at the above located workplace, employees required to spray paint were exposed to the hazards associated with clear coats, base coats, and gun cleaners that contained chemicals such as, but not limited to,  Xylene, 1-Propanol, and 2-Propanone. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  a. On or about June 05, 2013, at the above located workplace, employees required to spray paint were exposed to the hazards associated with chemicals such as, but not limited to, Methyl Amyl Ketone, 2-Butoxyethanol, and Acetone. These hazards necessitated the use of personal protective equipment such as safety glasses and gloves to prevent occupational injuries or illnesses. The employer had not verified, through written certification, that a hazard assessment had been performed.
