OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees when he helped the employee use a fiberglass step ladder to access a roof that was not in the fully-open position:  (a) Location: 216 NW 4 AVE., Hallandale, FL.  On or about, June 5, 2013, at the above addressed job-site, an employee was exposed to fall hazards when using a fiberglass step ladder that was not used in the fully-open position.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:  (a) Location: 216 NW 4 AVE, Hallandale, FL.  On or about, June 5, 2013, at the above addressed job-site, an employee was exposed to a 13-foot high fall hazard when cleaning gutters.
