29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   (a) Top Front Center of Structure - Employees working from scaffold approximately 20' in height attaching vinyl siding not protected from falling on to the concrete stairs, ground and scrap materials below on or about 6/6/13.

29 CFR 1926.1053(b)(1): 29 CFR 1926.1053(b)(1):     Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigged support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    (a) Top Front Center of Structure - Ladder used to gain access to pump jack scaffolding extended approximately 1' in height above surface landing allowing for ladder displacement, on or about 6/6/13.    Abatement Certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
