29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) On or about June 10, 2013 an employee was not certified or trained to operate a rough terrain fork truck, exposing the employee to the hazards associated with operating a rough terrain fork truck. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On June 10, 2013 employees were not protected from a fall while framing a residential property, exposing employees to fall hazards between 11 and 20.8 feet above grade. Instance 1. Employees were exposed to a fall while installing the exterior roof sheeting. Instance 2. Employees were exposed to a fall while walking and working around an unguarded stairwell on the second floor. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
