Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls. (a) In the warehouse, the employer did not effectively ensure employees compiled with prescribed safety precautions in connection with the retrieval of items from high shelves, including maintenance of three points of contact while carrying heavy or awkward items or loads that could cause the employee to lose balance or fall.

29 CFR 1910.176(b): Storage of material created a hazard: (a) In the receiving warehouse / infant tunnel, the employer did not ensure that storage shelves were secured properly to prevent accidental displacement. On or about June 4, 2013, an employee suffered head injuries from two falling shelves. Walmart Stores Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard [29 CFR 1910.176(b)], which was contained in OSHA inspection number 314539800, citation number 2, item number 1 and was affirmed as a final order on June 24, 2010, with respect to a workplace located at 6244 Wilmington Pike, Dayton, Ohio 45459.
