29 CFR 1910.38(c): The employer did not implement an emergency action plan which included at a minimum the elements required by paragraphs 1910.38(c)(1)-(6) of this part:   a) At the depot, the Emergency Action Plan established by the company did not include the following:    Procedures to report other emergencies; Procedures for emergency evacuations, including type of evacuation and exit route assignments; Procedures to account for all employees after evacuation; and Name or job title of every person who may be contacted by employees who need more information about the plan or an explanation of their duties under the plan.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  a) At the warehouse, employees were trained in October 21, 2009 and they were authorized to operate Forklift LPG Toyota, S/N 79401, on or about June 11, 2013.
