29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference 29 CFR 1926.59):     a)  At the site, where the employer did not maintain a written hazard communication program at the worksite. Employees used Holcim White Masonry Cement Type N to install bricks on the exterior of a newly constructed building. The cement contained hexavalent chromium and crystalline silica according to the product's packaging.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required safety data sheets (SDSs) for each hazardous chemical in the workplace (Construction Reference: 1926.59):     a)  At the site, where the employer did not ensure there was a safety data sheet present for the Holcim White Masonry Cement Type N, containing hexavalent chromium and crystalline silica. Employees were using the cement to install bricks on the exterior of a newly constructed building.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition:     a)  At the site, where an employee was installing bricks and masonry cement on the exterior of a newly constructed building without the use of gloves. This condition exposed an employee to dermal hazards due to the product containing hexavalent chromium and silica.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms:     a)  At the site, where there was no guardrail system installed on the top tier of the scaffold. The middle sections of the scaffold were missing a top and mid rail. This condition exposed employees to a fall hazard.     b) At the site, where there was no end rail installed on the east side of the top tier of the scaffold. This condition exposed employees to a fall hazard.
