29 CFR 1926.20(b)(2): Programs did not provide for frequent and regular inspections of the jobsite, materials, and equipment to be made by competent persons designated by the employers: a) The employer did not ensure that a competent person first conducted jobsite inspection to identify and correct fall hazard conditions before starting roof work. b) The competent person did not ensure that the extension ladder used to gain access to the roof was setup correctly. The ladder did extend at least 3 feet past the landing surface on the roof nor secured at the top of the ladder from being displaced.

29 CFR 1926.1053(b)(1): 29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigged support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: a) The aluminum extension ladder set up on the front side of the house and used to gain access to the roof surface did not extend 3 feet passed roof edge nor was the ladder secured at the top of the ladder to prevent displacement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Located along the roof area of the residential structure employees were observed performing roofing work assiciated operations on a 4 in 12 and 5 in 12 pitched roof section without conventional fall protection, following a fall protection plan or equivalent exposing employees to fall potentials in excess of 18'. The James Freeman was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number109747, citation number 01, item number 001 and was affirmed as a final order on 02/14/2012 with respect to a workplace located at 6775 Ruwes Oak Dr. Cincinnati, OH. 45248.
