OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) On or about June 12, 2013, the 9 foot tall stairway at the back of house 5 was not provided with standard stair rail, exposing employees to fall hazards. One feasible and acceptable method of abatement is to install standard stair rails along the open sides of all stairs in the egg laying houses in accordance with ANSI A1264.1 (Safety Requirements for Workplace Floor and Wall Openings, Stairs and Railing Systems) paragraph 5.5. (b) On or about June 12, 2013, the 9 foot tall stairway at the front of house 4 was not provided with a standard stair rail, exposing employees to fall hazards. One feasible and acceptable method of abatement is to install standard stair rails along the open sides of all stairs in the egg laying houses in accordance with ANSI A1264.1 (Safety Requirements for Workplace Floor and Wall Openings, Stairs and Railing Systems) paragraph 5.5. (c) On or about June 20, 2013, the 4 step stairway in the corridor entering house 3 was not provided with a standard stair rail, exposing employees to fall hazards. One feasible and acceptable method of abatement is to install standard stair rails along the open sides of all stairs in the egg laying houses in accordance with ANSI A1264.1 (Safety Requirements for Workplace Floor and Wall Openings, Stairs and Railing Systems) paragraph 5.5. (d) On or about June 20, 2013, employees were exposed to fall hazards of up to 8 feet 11 inches when overhead rollup doors located on the upper levels of the egg laying houses were opened. One feasible and acceptable method of abatement is to install standard guard rails along the wall openings outside of the doors on the upper level of the egg laying houses in accordance with ANSI A1264.1 (Safety Requirements for Workplace Floor and Wall Openings, Stairs and Railing Systems) paragraph 4. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Employees entered the lower level while unguarded fan blades were rotating to perform tasks such as catching loose chickens, or inspecting for water leaks. Contact with the unguarded fan blades could cause serious harm including amputation and death. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides except at the entrance to opening with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening: (a) Load Out #1 - The opening to the ladderway was not protected by either a swinging gate or offset so that a person could not walk directly into the opening. Employees climbed the fixed ladder to work on the catwalk and were exposed to a 13 foot fall through the unprotected ladderway on or about June 17, 2013. (b) Load Out #2 - The opening to the ladderway was not protected by either a swinging gate or offset so that a person could not walk directly into the opening. Employees climbed the fixed ladder to the catwalk on left side of the loadout bay, they then had to step over the ladderway opening to a small 12 inch wide platform in order to climb a short ladder to a second catwalk over the truck to the right side of the bay where loadout took place. Employees were exposed to a 13 foot fall through the unprotected ladderway on or about June 17, 2013. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.23(c)(2): Runways four feet or more above floor or ground level were not guarded by standard railings (or the equivalent) and toeboards: (a) Grain Receiving - Employees walked on a catwalk in the grain receiving building and stepped onto loaded grain trucks to obtain samples. The openings along the catwalk intended for employees to step from were not provided with chain mid rails, employees were required to remove the chains and step across gaps as much as 22 inches onto truck tops and were exposed to a fall hazard of approximately 14 feet to the ground below on or about June 17, 2013. (b) Load Out #1 - Employees walked and worked on a catwalk in load out #1 and stepped onto loaded grain trucks to monitor filling. The openings along the catwalk intended for employees to step from were not provided with chain mid rails, on or about June 17, 2013. (c) Load Out #2 - Employees walked and worked on a catwalk in load out #2 and stepped onto loaded grain trucks to monitor filling. The openings along the catwalk intended for employees to step from were not provided with chain mid rails, on or about June 17, 2013. (d) Load Out #1 - Employees walked and worked on a catwalk in load out #1 that did not have a standard railing on the ends. A diagonal structural beam crossed the end of the catwalk to provide a physical barrier but did not meet the requirements of a horizontal top rail on or about June 17, 2013. (e) Load Out #2 - Employees walked and worked on a catwalk in load out #2 that did not have a standard railing on the ends. 29 CFR 1910.184(f)(5)(iii): Wire rope sling(s) that had kinking, crushing, bird caging or other damage resulting in distortion of the wire rope structure were not immediately removed from service: (a) Rail Grain Receiving - The 5/8 inch steel reversing cable had a knot in it. Employees used the wire rope to reverse loaded rail cars weighing thousands of pounds on the siding when they travel too far down the track and are not positioned over the receiving chute in the floor. The knot in the rope was observed on or about June 17, 2013. No abatement certification or documentation required.
