29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. On or about June 11, 2013, at the jobsite an employee was observed working from a homemade steel platform which was mounted onto a forklift truck and raised to a height approximately 15 feet. The scaffold had a missing mid-rail and the employee was not wearing a personal fall arrest harness. The employee was exposed to fall hazards.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: On or about June 11, 2013, at the jobsite employee was working from a homemade steel platform which was mounted on an all-terrain forklift truck and raised to a height approximately 15 feet high. The employer did not have a written approval from the forklift truck manufacturer to allow such addition/modification to the forklift. The forklift truck or the platform could collapse and injure the employees.
