29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about 6/14/13  Location: Clarion Drive, White Plains, NY 10603  a) Employees performing roofing work on a sloped roof with a eave height of approximately 21 feet were not protected from falls by a personal fall arrest system or any other fall protection system.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about 6/14/13  Location: Clarion Drive, White Plains, NY 10603  a) Employees used a 32 foot Werner aluminium extension ladder to access a  roof at a height of approximately 21 feet. The ladder rails did not extene above the landing level at all.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  On or about 6/14/13  Location: Clarion Drive, White Plains, NY 10603  a) Employees used a Werner aluminium extension ladders that did not extend 3 feet above the landing level of the roof being accessed and used two Werner extension ladders that did not have the rope laynard required to be able to safely raise and lower the fly section. The emplyees were not trained by the employer in the hazards related to ladder use and the procedures to minimize such hazards.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  On or about: 6/14/13  Location: Clarion Drive, White Plains, NY 10603  a) Employees used a erner 32 foot and a Werner 24 foot aluminium extension ladders to access a roof. Both ladders were missing the laynard rope used to safely raise and lower the fly section.
