29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:      a)  On or about June 13, 2013, Northland Construction, Inc., as a controlling contractor, failed to ensure that John Obialero, Inc. (subcontractor) protected employees from cave-ins while they worked in an excavation which was not protected by an adequate protective system.  Employees worked in an excavation which was approximately 8-9 feet deep.  The excavation had straight cut walls with an inadequate shoring system in that soil was located in front of the concrete shoring piers.
