29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) On or about 06/21/13 CSHO observed three men loading roofing materials at ground level with overhead work being done when these men were not wearing any head protection, i.e. hard hats.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access:  a) On or about 06/21/13 employee stated during interview that he used a Werner 20 foot portable aluminum extension ladder to access the roof above the front door to repair the soffit when the ladder did not extend three feet above the landing.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identified them as defective, or tagged with Do Not Use or similar language, and were not withdrawn from service until repaired:   a) On or about 06/21/13 employee stated during interview that the Werner 20 foot portable aluminum extension ladder was used to access the roof above the front door to repair the soffit. The ladder was damaged in that the side rails were bent, rungs were crushed and was not tagged "Do Not Use" or taken out of service.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:    a) On or about 06/21/13 two men were working on and from the roof of a single family, two story home installing new roofing materials with no fall protection systems in place.      FPS Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 313861536, citation number 1, item number 5 and was affirmed as a final order on 05/14/2010, with respect to a workplace located at 339 Belgrove Drive, Kearny, NJ 07032.
