29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    a) Jobsite: Lot 56 Next to 113 Cassina St, Middletown, DE - Employees were exposed to approximately a 15' fall hazard while conducting roofing work without fall protection. Observed on or about 6/21/13.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Jobsite: Lot 56 Next to 113 Cassina St, Middletown, DE -Employees were exposed to approximately a 15' fall hazard while conducting roofing work without fall protection training. Observed on or about 6/21/13.  Note: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement
