29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:    a- 1722 Route 35 North, Ortley Beach NJ:  Company employees working at the unprotected edges of a building's second story balcony were exposed to fall hazards of approximately 20 feet 5 inches to the ground surface below when they were not supplied with any type of fall protection.  Condition observed on or about 06/21/13.

29 CFR 1926.503(a)(1): A training program was not provided to each employee who might be exposed to fall hazards, to enable that employee to recognize the hazards of falling, and be trained in the procedures to be followed to minimize these hazards:    a- 1722 Route 35 North, Ortley Beach NJ: Company employees were exposed to fall hazards of approximately 20 feet 5 inches  to the ground surface below, when performing guardrail installation/replacement and other related activities without the use of any fall protection.  These company employees had not received fall protection training.  Condition observed on or about 06/21/13.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
