OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to cuts and laceration hazards.    On or about June 23, 2013, at a residential job site, the employer failed to ensure proper chain saw operating procedures were utilized by an employee engaged in removal of branches and tree limbs while working from an elevated location within a tree.

29 CFR 1910.242(a): Hand and portable powered tools or equipment were not kept in safe condition.   On or about June 23, 2013, at a residential job site, an employee utilized an ECHO chainsaw to remove branches and tree limbs within a tree.  The chain saw was used without a protective anti-kickback guard exposing the employee to amputation hazards.
