29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about June 26, 2013, at 601 Fairview & Curzon, in Fort Worth, Texas employees installing a new 8 inch sewer line inside a trench were not protected from falling rock/dirt when the spoil pile and other materials were located along the south side of the trench. Employees were exposed to struck by and cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i): On or about June 26, 2013, at 601 Fairview & Curzon, in Fort Worth, Texas employees installing a new 8 inch sewer line inside a trench were not protected from cave-ins, the system in place was lacking vertical support and end pieces, exposing employees to cave-in hazards.
