29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    (a) 611 Woodfield Road, West Hempstead, NY (Worksite), Roof of building - An employee engaged in steel erection, removal of the existing metal roof decking, was working without fall protection and fell 18'-6" to the ground below, on or about July 1, 2013.    (b) Worksite, Roof of building - Employees engaged in steel erection activities involving the removal of the existing metal roof decking; and the installation and welding of replacement metal roof decking, were working without fall protection and exposed to fall hazards of 18'-6" to the ground below, on or about July 1, 2013.      Note: In addition to abatement certification, the employer is also required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761:    (a) Worksite, Roof - Employees engaged in steel erection activities involving the removal of the existing metal roof decking; and the installation and welding of replacement metal roof decking, were working without fall protection; exposed to fall hazards of 18'-6" to the ground below; and were not trained, on or about July 1, 2013.      Note: In addition to abatement certification, the employer is also required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
