The employer shall use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors. Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Location: 247 W. 13th St., New York, NY. a) Employer failed to ensure that employees were protected from falling while working and/or walking near unprotected sides or edges at the site. Employees were exposed to potential fall hazards of up to approximately 6 ft.; on or about 6/27/13.
