29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) MC Foundations @ 16442 E. 96th Way, Commerce City, CO 80022: On and before June 28th, 2013, the employer did not protect the employees from other materials that posed the a hazard of falling into the excavation, such as, existing residential fencing. The residential excavation was dug on the adjacent property line exposing the wooden structural posts of the wooden fencing.  The stability of the fencing was compromised by the excavation. This condition exposed employees to falling object hazard.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a) MC Foundations, 16442 E. 96th Way, Commerce City, CO 80022: On and before June 28th, 2013 the employer did not have a competent person inspect the excavation daily prior to allowing employees to enter a hazardous condition which could have resulted in materials falling into the excavation and excavation wall cave-in. In addition, an inspection was not conducted by a competent person prior to the start of work and as needed throughout the shift. The material surcharge load comprising of a residential fence above the excavation wall was closer than 2 feet from the edge of the excavation. This condition exposed employees to cave-in hazards and falling object exposure.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    a) MC Foundations, 16442 E. 96th Way, Commerce City, CO 80022: On and before June 28th, 2013 the employer did not have a method of egress from the excavation.  An employee was working in an excavation without a means of egress while attempting to add hardware to the formwork.  The employee did not have a means of egress at a minimum of 25 feet from the location work was being conducted.  This condition exposed employees to falling as a result of attempting to climb the excavation wall to egress.
