29 CFR 1926.454(b): The employer did not have each employee who was involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in:    (a) (Worksite), Second story roof, back of house - The employee exposed to fall hazards while erecting the pump jack scaffolding systems, was not trained to recognize the hazards associated with the work, on or about July 5, 2013.    (b) (Worksite), Main Entryway, front of house - The employee working from the job made scaffold, which was erected with 2" x 6" wooden planks and defective portable ladders, was not trained to recognize the hazards associated with the work, on or about July 5, 2013.      Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a) 5 Araca Road, Babylon, NY (Worksite), Second story roof, back of house - An employee was anchoring pump jack scaffolding brackets on the second story roof, approximately 23' above the ground, without fall protection. The employee was not protected from falling to the ground below by a guardrail, safety net, or personal fall arrest system, on or about July 5, 2013.      Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

The employee was not trained to recognize the hazard of falling; or trained in the procedures to minimize those hazards, on or about July 5, 2013. 29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.    (a) (Worksite), Main Entryway, front of house - The employee installing vinyl siding above the main entryway was working from a job made platform, which was constructed using separated sections of a portable extension ladder. The bbase section of the ladder had structural defects, in that the safety shoes were missing, on or about July 5, 2013.       Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
