29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:    a)  Employees working in the trench were not protected against the hazards related to water accumulation.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a)  An extension ladder used by employees to access and egress the trench had structural defects, such as, split rails.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):      a)  Employees were not protected from the hazard of cave-in while working in a trench measuring approximately 7.1 feet in depth.    Poli Contracting, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA violation number 313935975, citation 2, item 1, issued on August 6, 2010, and became final order on or about August 26, 2010, with respect to a workplace located at 70th and Ashland, Chicago, IL 60636.    Poli Contracting, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA violation number 312595903, citation 2, item 1, issued on June 15, 2009, and became final order on or about July 8, 2009, with respect to a workplace located at 558 W. 43rd Str., Chicago, IL 60609.     Poli Contracting, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA violation number 312590748, citation 1, item 1a, issued on December 17, 2008, and became final order on or about December 31, 2008, with respect to a workplace located at 2318 South Canal, Chicago, IL 60616.    No abatement certification or documentation is required for this item.
