OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious  physical harm to employees in that employees were exposed to the hazard of being struck by a falling load of stone.    On or about July 9, 2013, the bucket used on the Komatsu WA320 Frontend Loader had cracks around the two lower attachment points, exposing employees to the hazard of being struck by a falling load of stone in the event of structural failure of the bucket attachment points.
