29 CFR 1926.1101(f)(1)(i): Where exposure monitoring was required under 29 CFR 1926.1101, the employer did not perform monitoring to determine accurately the airborne concentrations of asbestos to which employees were or potentially were exposed: a) On or about July 9, 2013, at the VA Medical Center, 2250 Leestown Rd, Lexington, Ky, Winter Environmental employees were exposed to asbestos containing materials and air samples collected were not analyzed to determine employees exposures and to ensure proper personal protective equipment was selected. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1101(f)(2)(iii)(A): The employer did not demonstrate that employee exposures were below the permissible exposure limits (PELs) by objective data demonstrating that the product or material containing asbestos minerals or the activity involving such product or material could not release airborne fibers in concentrations exceeding the TWA and excursion limit under those work conditions having the greatest potential for releasing asbestos: a) On or about July 9, 2013, at the VA Medical Center, 2250 Leestown Rd, Lexington, Ky, Winter Environmental employees were exposed to asbestos containng TSI Piping and asbestos contaminated soil. The negative exposure assessment did not include assessment of asbestos containing soil and therefore is not adequate in assessing employees exposures to these materials. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1101(h)(3)(iv)(A): The employer did not provide employees with a tight-fitting powered air-purifying respirator operated in the pressure-demand mode and equipped with either HEPA egress cartridges or an auxiliary positive-pressure self-contained breathing apparatus, whenever the employees were in regulated area performing Class I asbestos work for which a negative exposure assessment was not available and the exposure assessment indicated that the exposure level will be at or below 1 fiber per cubic centimeter as an 8-hour time weighted average: a) On or about July 9, 2013, at the VA Medical Center, 2250 Leestown Rd, Lexington, Ky, Winter Environmental employees were exposed to asbestos containing TSI Piping and asbestos contaminated soil without a proper negative exposure assessment or initial personal employee air monitoring and were using half face air purifying respirators to abate these materials. 29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present using an identity that was referenced on the appropriate material safety data sheet: (Construction Reference: 1926.59) (a)) On or about July 9, 2013, at the VA Medical Center, 2250 Leestown Rd, Lexington, Ky, Winter Environmental employees were exposed to various hazardous materials (i.e., chrysotile and amosite asbestos, diesel fuel, Ramtack, encapsulant, and surfactant) covered by the hazardous communication standard and did not have access to a list of hazardous materials used on the work site. Without proper information on hazardous materials, employees could mis-handle hazardous materials and expose themselves to allergic reactions, skin, and respiratory irritations. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1101(p)(1): Appendices A, C, D, and E to this section are incorporated as part of this section and the contents of these appendices are mandatory. 29 CFR 1926.1101 Appendix A: Each set of samples did not include 10% field blanks or a minimum of 2 field blanks. a) On or about July 9, 2013, at the VA Medical Center, 2250 Leestown Rd, Lexington, Ky, Winter Environmental employees were exposed to asbestos containing TSI Piping and asbestos containing soil during abatement of these materials in the crawl space of Building 25. Air samples were collected on 6/17/13; 6/18/13; 6/19/13; 6/26/13; and 6/27/13 and submitted for analysis without any field blanks. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
