29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered, controls neutralized, and the brakes set to prevent movement. 60 Railroad St, Lee, MA On July 23, 2013, two dismounted powered industrial trucks had elevated loads of lumber with one being plastic wrapped by an employee, exposing him to crushing hazards of the suspended load.

29 CFR 1910.178(q)(7): Industrial trucks were not examined at least daily before being placed in service: 60 Railroad St, Lee, MA On July 23, 2013 and at times prior, the employer did not ensure that powered industrial trucks were examined daily before being used. Operational examination uncovered safety-related defects on industrial trucks: two with inoperative emergency brakes and another two with inoperative back-up alarm/lights.
