29 CFR 1910.134(c)(2)(i): The employer did not provide the respirator users with the information contained in Appendix D of this section for employer permitted voluntary respirator use:   This violation occurred on or about July 23, 2013 and at times prior thereto, employees performing bin cleaning operations voluntarily wearing N95 filtering face piece respirators were not provided with Appendix D of the respiratory protection standard.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form.      This violation occurred on or about July 23, 2013 and at times prior thereto, Western Producers Coop did not conduct an adequate evaluation of the respiratory hazards associated with the cleaning of the bins exposing employees to the respiratory hazards of grain dust.
