OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on or about July 23, 2013, pulp operators in the rotary room were exposed to the rotating digger plate(s) and tank heads on the eight digester vessels due to an Bobcat S130 (A3KY36939) skid-steer loader in use for removing cooked stock that had the ROPS/FOPS removed without the manufacturers approval. Among means of a feasible abatement is to follow the Bobcat Operation & Maintenance Manual for the S130 Skid Steer Loader S/NA3KY20001 & Above, manufactures recommendations. The manual references the safety and importance of the operators cab, ROPS & FOPS in several locations throughout the entire manual.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. a) On or about July 23, 2013, pulp operators were exposed to the rotating digger plate(s) and tank heads on the eight rotating digester vessels that were not shut down or guarded when removing stock from underneath by Bobcat or by hand.
