29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.   a) 1st Floor Addition, South Side of the Building - Masons were observed working from a tubular welded frame scaffold without having ladder access for egress exposing them to a 6 foot 6 inch fall hazard, on or about 07/25/13.   This contractor is the controlling and correcting employer at the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he corrected observed hazards involving the sub-contractor prior to the inspection. Therefore, he was aware of the operations in progress. This contractor is being cited Under the Multi-Employer Workplace Policy in addition to having exposed employees to this hazard.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) 2nd Floor Addition, South Side of the Building - An owner/superintendent was observed without fall protection, standing at an unguarded open sided floor while monitoring masonry operations exposing him to a 17 foot fall hazard, on or about 07/25/13.     b) 2nd Floor Addition, Southwest Corner of the Building - An owner/superintendent was observed without fall protection, standing near an unguarded floor hole while monitoring masonry operations exposing him to a 10 foot fall hazard through the floor hole, on or about 07/25/13. .      c) 2nd Floor, South Side of the Building - An owner/superintendent was observed working near an unguarded window opening exposing him to a 17 foot fall hazard, on or about 07/25/13. .      d ) 1st Floor, West Side of the Building - A masons helper was observed on a ramp without adequate fall protection exposing him to a 7 foot 7 inch fall hazard, on or about 07/25/13.    This contractor is the general contractor for the site, thusly; they are the controlling and correcting employer for the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he was aware of the operations in progress. This contractor could have been cited Under the Multi-Employer Workplace Policy in addition to having exposed employees to this hazard.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with one or more standard handrails:   a) West Side, Main Entrance into the Building - Carpenters were observed using the stairs without a standard handrail the building carrying materials exposing them to a 5 foot fall hazard, on or about 07/25/13.   b) West Side, Main Entrance into the Building - The owner/superintendent was observed using the stairs which was not equipped with a standard hand rail exposing him to a 5 foot fall hazard.   This contractor is the controlling and correcting employer at the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he corrected observed hazards involving the sub-contractor prior to the inspection. Therefore, he was aware of the operations in progress.
