29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    (a) East Fifth Street, Huntington, NY (Worksite), north side of East Fifth Street, water main trench - Employees were installing a new 12" diameter Ductile Iron Pipe (DIP) water main in an unprotected trench. The employees worked, without protective helmets, near and directly below loads that were being hoisted by the New Holland excavator, Model # EH 130 / Serial # N5TA13063; and next to spoil piles that were piled approximately 3' high on the south edge of the trench on, or about July 31, 2013.          Note: Because the abatement for this violation was previously documented, the employer need not submit abatement certification for this violation in accordance with 29 CFR 1903.19.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a) (Worksite), north side of East Fifth Street, water main trench - Employees were installing a new 12" diameter Ductile Iron Pipe (DIP) water main in an unprotected trench. The trench had vertical walls and measured 80' L x 42" W x 5'-10" D. The employees were directed to work in the unprotected trench and were not provided with a means of egress on, or about July 31, 2013.          Note: Because the abatement for this violation was previously documented, the employer need not submit abatement certification for this violation in accordance with 29 CFR 1903.19.

29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation were not tested prior allowing employees to enter an excavation greater than 4 feet (1.22 m) in depth.      (a) East Fifth Street, Huntington, NY (Worksite), north side of East Fifth Street, water main trench, below sewer utility - Employees were installing a new 12" diameter Ductile Iron Pipe (DIP) water main below the existing sewer utility that was located between Station #'s 14+80 and 15+00. The water main was being installed, at a depth of 5'-10", which was approximately 18" below the sewer utility where methane and hydrogen sulfide could reasonably be expected to exist. The atmosphere was not tested prior to allowing the employees to enter the trench on, or about July 31, 2013.          NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this violation in accordance with 29 CFR 1903.19.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.       (a) East Fifth Street, Huntington, NY (Worksite), north side of East Fifth Street, water main trench - Employees were installing a new 12" diameter Ductile Iron Pipe (DIP) water main in an unprotected trench, which measured 80' L x 42" W x 5'-10" D. The excavated spoils were placed directly onto the north and south edges of the trench. The spoil piles were between 1' and 3' in height and spanned the entire length of the trench. The spoil piles should have been placed 2' or more from the edges of the trench on, or about July 31, 2013.      (b) East Fifth Street, Huntington, NY (Worksite), north side of East Fifth Street, water main trench - Employees were installing a new 12" diameter Ductile Iron Pipe (DIP) water main in an unprotected trench, which measured 80' L x 42" W x 5'-10" D. During the excavation and installation processes, the New Holland excavator, Model # EH 130 / Serial # N5TA13063, was operated while in a straddled position directly over the unprotected trench.  At times, the excavator's tracks were on and/or within 1' of the edges of the trench when it was operated in this manner. The excavator should have maintained a minimum 2' clearance from the edge of the trench on, or about July 31, 2013.          NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this violation in accordance with 29 CFR 1903.19.

The trench had visible deficiencies such as, but not limited to spoils were placed directly onto the north and south edges of the trench; lacked a means of egress; lacked a form of protection against cave-in hazards; and equipment operating directly over and within 1' of the trench. The trench was not inspected by a competent person on, or about July 31, 2013.          NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this violation in accordance with 29 CFR 1903.19.
