OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards:   (a). Workplace located at 9406 N. Highway 33, Osborn, Missouri- On or about July 28, 2013, an employee was fatally injured as a result of being trampled by a bull and/or cow while moving cattle from the milking parlor to the free stall barn. The employee, herding livestock into the barn, was exposed to crushing injuries while working in and around the livestock. Employees were not adequately trained in safe procedures when working with and near milking cows and bulls.   Among other methods, recognized and feasible means of abatement to correct this hazard are:       1)    Follow the guidelines in the National Institute for Animal Agriculture, Livestock Handling Guide.       2)    Develop and implement safe policies and procedures on handling livestock.       3)    Conduct periodic safety training on the proper handling of livestock, especially when working with bulls.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
