29 CFR 1910.67(c)(2)(i): Lift controls shall be tested each day prior to use to determine that such controls are in safe working condition.    a)      On or about 06-20-13, employees who were performing tree service job tasks were working from a lift platform on a Terex Telelect Hi-Ranger 5TC Series aerial lift with malfunctioning upper/lift controls; the lower controls' palm switch button was used continuously to allow power to the upper/lift controls.  Manufacturer recommends when an operator is in the lift platform the palm switch button is to be engaged only when the operator in the platform is not able to operate the unit.       ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1910.67(c)(2)(vii): The brakes shall be set and outriggers, when used, shall be positioned on pads or a solid surface. Wheel chocks shall be installed before using an aerial lift on an incline.    a)      On or about 06-20-13, employees were operating a Terex Telelect Hi-Ranger 5TC Series aerial lift on a grassy surface without manufacture's recommended outrigger support pads; four 2 in. T x 12 in. W x 26 in. L boards were used by placing one under each of the four outrigger pads.  Manufacturer recommends each support pad to be 24 inches W x 24 inches L made of three layers of 3/4 inch plywood.  Two of the four outrigger support pads cracked and/or broke.      ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1910.151(b): There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid:      a)      On or about 06-20-13, the employer did not provide first-aid training to employees who were performing tree removal on a site located more than five minutes from emergency first-aid services; employees were utilizing an aerial lift platform at heights greater than forty (40) feet above ground level, chain saws, and a wood chipper.
