29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration: a- 2760 West, Ocean City NJ: On or about 07/15/13, a company employee was exposed to fall hazards, in excess of 25 feet to the ground surface below, while working from a job made scaffold that was not supplied with midrails, top rails, end stops, was supported at both ends by unrated pieces of wood, and whose walking/working surface was not secured to the supports. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a- 2760 West, Ocean City NJ: On or about 07/15/13, a company employee performing framing, sheathing installation, and other related activities from a job made scaffold with a walking/working surface in excess of 25 feet to the ground surface below, was not protected from falling.
