29 CFR 1926.501(b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system or another provision in paragraph (b) of this section providing for an alternative fall protection measure: At the job site, the employer failed to ensure that exposed employees installing roofing shingles upon a residential roof were using fall protection. The slope of the roof was approximately 5:12. The eave to ground height was approximately eight (8) feet. Eduardo Paul Portillo was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 769802, citation number 1, item number 1, and was affirmed as a final order on 04/15/13, with respect to a workplace located at 8830 Harrison Avenue, Brentwood, MO 63144.
