OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  a. Yard - Noted on or about7/30/13 and at times prior thereto, it was observed that a Hyster 4-ton forklift, SN: LD2138-6U6703926,  was not equipped with seatbelts.        Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is to:    Install a seat belt retro-fit package and require that a seat belt be worn when the truck is operated.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:         a.  Machine Shop - Noted on or about 7/30/13 and at times prior thereto, the following bench grinders were observed deficient in the following ways:    1.  A Ryobi 8" double wheeled bench grinder was missing a tongue guard on the left side. On the right side, there was a 3/4" gap between the  tongue guard and the abrasive wheel.  2.  On the rear wall, a floor mounted grinder was missing a tongue guard.  The manufacturer's label in illegible.
