29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   The employer does not ensure the use of a ladder, ramp, or other safe means of egress in excavations that are 4 feet or more in depth.  This violation was observed on or about August 7, 2013, at the site where an employee was exposed to a fall hazard when entering and exiting an excavation without a safe means of egress.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided a safe means of egress when working in excavations that are 4 feet or more in depth.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:   The employer does not protect employees from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations.  This violation was observed on or about August 7, 2013, at the site where an employee was exposed to a struck-by hazard when working in an excavation without placing and keeping the spoil pile at least 2 feet from the edge of the excavation.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into the excavation.
