OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) On or about 8/5/2013, End of Group 4: Employees were exposed to falls of up to eight feet into manure storage pits located at the end of barn floors, through floor openings. b) On or about 8/5/2013, Old Manure Room: Employees were exposed to falls of up to eight feet into a manure storage pit located by the pumping tractor. c) On or about 8/5/2013, Pump Room: Employees were exposed to falls of up to eight feet into a manure storage pit located near the squeezer pump. d) On or about 8/5/2013, Outside of New Parlor: Employees were exposed to falls of up to eight feet into an open pit, partially covered with brush and grass. Among other feasible and acceptable means of abatement would be to comply with the American National Standards Institute, ANSI, Standard A1264.1-2007, Safety Requirements for Floor and Wall Openings, Railings, and Toeboards, Section 3. Abatement certification is required for this item.

Among other feasible and acceptable means of abatement would be to comply with the National Fire Protection Association (NFPA) Code 70, National Electric Code, Section 110.27. Abatement certification is required for this item.
