(a) Picnic shelter: On or about July 25, 2013 and at times prior thereto, employees utilizing hand tools, such as but not limited to a circular saw and nail gun, were not wearing safety glasses.   Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) Picnic shelter: On or about July 25, 2013 and at times prior thereto, an employee working with a nail gun at approximately 12.1 feet on sheathing the shelter did not have any apparent means of fall protection.  (b) Picnic shelter: On or about July 25, 2013 and at times prior thereto, an employee working with a circular saw at approximately 8.5 feet on sheathing the shelter did not have any apparent means of fall protection.   Note: Abatement certification is NOT required for this item.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Picnic shelter: On or about July 25, 2013 and at times prior thereto, employees utilizing a ladder to access the roof had the ladder extended approximately 12 inches above the upper landing surface of the roof.  Note: Abatement certification is NOT required for this item.
