OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard:  a.  On or about August 13, 2013, an employee climbing trees and working with a chain saw to cut trees was not a qualified arborist, exposing himself to a 51 feet fall hazard.  Among other methods, one feasible and acceptable abatement methods to correct this hazard is to ensure that his employees are qualified arborists in accordance with ANSI Z133.1-2012.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a. On or about August 13, 2013, employees using chain saws to cut trees were not wearing eye protection or face shields, exposing themselves to eye injuries.

On or about August 13, 2013, employees working on the ground underneath another employee cutting branches and trimming trees were not wearing hard hats, exposing themselves to head injuries.
