29 CFR 1926.102(a)(1):   Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents    a) Worksite, Roosevelt Blvd. Long Beach NY - Employees were using a pneumatic nail gun to install asphalt shingles on the roof of a two story residential home.  The employees were not provided with eye protection; on or about 08/14/13.     Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:      a)  Worksite, Roosevelt Blvd. Long Beach NY, Southwest side - Employees were accessing the roof of a two story residential home by using an extension ladder that was extended approximately 1 1/2ft above the landing; on or about 08/14/13.    b)  Worksite, Roosevelt Blvd. Long Beach NY Southeast side -  Employees were accessing the roof of a two story residential home by using an extension ladder that was extended approximately 2 1/2ft above the landing; on or about 8/14/13.     c)  Worksite, Roosevelt Blvd. Long Beach NY North side -  Employees were accessing the roof of a two story residential home by using an extension ladder that was extended approximately 2 1/2ft above the landing; on or about 8/14/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.100(a):   Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:      a)  Worksite, Roosevelt Blvd. Long Beach NY - Employees were not wearing protective helmets and were exposed to being struck by asphalt shingles and tools while walking and working below overhead roofing work; on or about 08/14/13.      Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.      Wagner Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number# 315332403, citation number 1 item number 1, and was affirmed as a final order on 5/16/2011, with respect to a worksite located at 343 Boundary Ave., Plainedge, NY 11714.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, Roosevelt Blvd. Long Beach NY - Employees were installing asphalt shingles on the roof of a two story residential home.  The employees were not protected from falling approximately 22ft to the ground below; on or about 08/14/13.       Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.    Wagner Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number# 315332403, citation number 1 item number 2, and was affirmed as a final order on 5/16/2011, with respect to a worksite located at 343 Boundary Ave., Plainedge, NY 11714.
