29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a)  176 Route 46 West, Denville, NJ and at the Corporate Offices at 9 Springbrook Road, Hackettstown, NJ.    The operator of the Lull Model 844 C-42 Rough Terrain Forklift who was lifting a worker on the tines of his forklift with a makeshift platform of Flakeboard sheets had not received training and evaluation on powered industrial trucks as specified in paragraph (l).                                                    Violation observed on or about 08/20/2013.

A worker was exposed to falls as the employer used the rough terrain forklift to support the makeshift scaffold platform of Flakeboard when neither the forklift or the platform were designed by the manufacturer for that purpose.
